Terms of service

The operator of kmarket.uz is MYSTAR MCHJ (tax ID: 311854086), at Republic of Uzbekistan, Samarkand region, Ishtikhon district (the Platform). The Platform provides a venue for selling software products and a payment service; it is not the author of the projects sold on it.

Using the Platform, creating an account or placing an order counts as full acceptance of these terms. If you do not accept them, do not use the Platform.

Seller — a user who lists their project on the Platform. Buyer — a user who takes a licence to a project. Project — a software product consisting of source code and the files that belong with it.

Order — the record created to buy a particular project. Licence — the right of use passed to the Buyer. Balance — a Seller's account on the Platform.

The Platform lets a Seller publish a project and a Buyer acquire it, and takes part in the payment as an intermediary.

Rights in the project arise between the Seller and the Buyer. The Platform takes part as the party receiving payment and running moderation; it is neither the author nor the owner of the project.

The Seller warrants that they hold every right needed in the project they list and that it infringes nobody else's rights.

The description, the screenshots, the list of technologies and the demo must match reality. An archive may not contain malware, hidden means of access, or anyone else's confidential data or keys.

The Seller must answer Buyers' questions and disputes in good time, and try to fix a fault in the project with an update.

Once the payment is confirmed the Buyer may download the archive immediately. Downloads are capped at 20 a day.

If the Seller releases a new version of the project, the Buyer receives it at no extra cost.

The Buyer may open a dispute within 7 days of paying, on the grounds listed under «Refunds and disputes».

Unless the listing says otherwise, the Buyer receives a non-exclusive, perpetual licence: the right to use and modify the code in one product of their own or in one client's product.

Reselling the code, in its original or a modified form, listing it on other marketplaces, or distributing it as a template or a builder, is not allowed.

Where a listing states additional terms, those apply to the extent that they do not contradict this section.

Payment is made through Click or Payme into the Platform's account. An unpaid order is cancelled after 30 minutes.

The Platform retains 15% of each sale. The remainder is credited to the Seller's balance and becomes withdrawable after 7 days.

Payouts start at 50,000 UZS and go to the card the Seller has given. Every request is checked by the Platform.

A dispute is opened within 7 days of payment. Grounds: the project does not work; does not match its description, screenshots or demo; files the listing promises are missing; there is an unfixed security vulnerability. While the archive has not been downloaded, the Buyer may ask for a refund without giving a reason.

The following are not grounds for a refund: a change of mind after the archive has been downloaded; the Buyer lacking the experience to install or use the project; the project not meeting expectations while matching its description; needing a feature the description does not promise; a problem that is not explained or shown.

The Seller is given 3 days to answer. The Seller may refund, release a fixed version within 5 days, or contest. After a fix the Buyer closes the dispute or refers it to the Platform. Without an answer, or where the parties cannot agree, the Platform decides on the information provided and the download history.

While a dispute is open, the amount due to the Seller from that sale is held. Where a refund is granted, the amount returns to the Buyer by the original payment method, the licence is revoked, and the sale leaves the Seller's statistics.

The following may not be listed: someone else's code without the rightsholder's permission; products that break the terms of a licence; malware, botnet and spam tooling; projects for gambling, fraud or stealing user data.

Also prohibited: archives that do not run, are empty or do not match their description, and listings created only as advertising.

The Platform may moderate any listing, refuse to publish it, or take it down. The reason for a refusal is given to the Seller.

Repeated breaches suspend the Seller's account: every listing of theirs is hidden from the site, while open disputes are decided in the usual way.

The Platform is not the author of a project and does not warrant its fitness for any particular purpose. The Platform's liability is limited to the amount of the order in question.

The Platform is not liable for loss caused by outages in third-party services (payment providers, hosting, messaging channels).

The Platform may amend these terms. A new version is published on this page and takes effect from publication; an order is governed by the version in force when it was placed.

These terms are governed by the law of the Republic of Uzbekistan. Disagreements are settled first by negotiation and, failing that, in the manner the law provides.
